Terms of Service

1. Acceptance

These Terms govern your use of Hito, a focus and productivity app provided by Hito Labs (Tax ID: pending incorporation; address: pending incorporation; «Hito», «we»). By creating an account or using the service you accept these Terms. If you do not agree, do not use Hito.

2. The service

Hito helps you break goals into milestones, block distractions during your focus sessions and measure the hours you spend on what matters. The beta is available for Windows. Other platforms will follow when they are ready.

3. Your account and the minimum age

You need an account to sync your data across devices. To create one you must be 18 or older and provide accurate information.

You are responsible for keeping your credentials secure and for all activity under your account. Let us know if you detect unauthorized use.

4. Acceptable use

When using Hito you agree not to:

• use the service for unlawful purposes or to infringe the rights of others;
• attempt to access accounts, systems or data that are not yours;
• interfere with the operation of the service or circumvent its technical limits;
• resell or commercially exploit the service without our permission.

5. The beta

Hito is in beta and free of charge while it lasts. As a beta, we do not guarantee continuous availability: it may have bugs, interruptions or changes without notice, and in an extreme case you could lose data.

We recommend exporting your milestones and plans from time to time ("Download my data" in Settings → Your data on the web, or the desktop export) as a backup.

6. The artificial intelligence assistant

The assistant uses artificial intelligence to propose a plan from your milestone and your availability. It is a proposal, it can be wrong, and the final call — reviewing, adjusting or confirming the plan — is always yours.

7. Distraction blocking

Blocking apps during your focus sessions is a help to stay concentrated, not a guarantee that you will not get distracted: it can fail or have technical limits that do not cover every case.

8. Subscription and payments

Today Hito is free. If there is ever a paid plan, we will tell you beforehand, you will never be charged without accepting it, and you will have a 14-day withdrawal and refund right.

9. Intellectual property

Hito and its software, brand and design belong to Hito's owner (see Legal notice). You retain ownership of the data and content you create (your milestones, sessions and goals). You grant us only the permissions needed to provide the service (for example, storing and syncing your data).

10. Availability and changes

We strive to keep the service available, but we do not guarantee uninterrupted operation. We may modify, suspend or discontinue features, notifying you when the change is significant.

11. Limitation of liability

To the extent permitted by law, Hito is provided without warranties and we will not be liable for indirect damages, beta bugs or data loss arising from use of the service.

This limitation never covers damages caused by willful misconduct or gross negligence (dolo o culpa grave), nor the rights that Spanish consumer law (Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios, TRLGDCU, art. 86) grants consumers and that cannot be excluded by contract.

12. Termination

You may stop using Hito and delete your account at any time, at no cost. We may suspend or close your account if you breach these Terms or where required for legal or security reasons.

13. Governing law and courts

These Terms are governed by Spanish law. If you are a consumer, any dispute will be submitted to the courts of your place of residence, in accordance with applicable consumer regulations.
